City of Palm Springs Settles Nearly $1M for Patio Rights in Plaza Threatre

The city of Palm Springs and Grit Development
reached a settlement of nearly $1 million regarding access rights of a
restaurant patio hindering the development of the city's Plaza Theatre, city
officials announced today.

The $986,500 settlement refers to the design and installation of a
patio ``within a portion of the public sidewalk in front of the Kalura
restaurant,'' with the city signing off on the patio design due to public
safety prior to construction, according to the signed court agreement.

In December 2024, the city filed an eminent domain lawsuit against the
Plaza Theatre Restoration Project and made a deposit of $604,000 for the
property. However, Grit Development, the owners of Kalura Trattoria, filed a
cross-complaint against the city in Feb. for inverse condemnation of the
property, according to the document.

As part of the settlement agreement, the city will pay Grit, and will
work with them on the patio for safety reasons.

``The city of Palm Springs is pleased to have reached a positive
resolution with Grit Development regarding access rights to the historic Plaza
Theatre. From the beginning, the city's focus has been on ensuring public
safety while preserving one of Palm Springs' most iconic cultural landmarks,''
city officials said in a statement.

``With the resolution of issues surrounding the patio and easement,
the city is looking forward to finishing the project and restoring the theatre
to its original glory. We thank Grit Development for their collaboration and
ongoing investment in our community. Together, we look forward to a revitalized
Plaza Theatre that will benefit residents, visitors and future generations.''
