US Court Halts Trump’s Global Tariffs, Citing Lack of Emergency Justification

A three-judge panel at the US Court of International Trade has ruled to stop most of Donald Trump’s global tariffs, including his “Liberation Day” tariffs imposed in April. The decision blocks Trump’s 30% tariffs on China, 25% on goods from Mexico and Canada, and 10% on most imports into the United States.

The panel found that the Trump administration’s invocation of the International Emergency Economic Powers Act (IEEPA) to justify the tariffs lacked the criteria for a national emergency. The court concluded that IEEPA does not grant the president authority to impose such tariffs, ruling them an unconstitutional delegation of Congress’s tariff-setting powers.

The lawsuit, filed by the Liberty Justice Center on behalf of small businesses like wine seller VOS Selections, was combined with a separate challenge from twelve Democratic states. Plaintiffs argued that these tariffs were imposed without Congressional approval and had severely harmed small businesses across the country.

“This ruling reaffirms that our laws matter, and that trade decisions can’t be made on the president’s whim,” said Oregon Attorney General Dan Rayfield.

The White House did not immediately comment, but a spokesperson previously claimed trade deficits were a “national emergency.” Stock markets responded positively to the ruling, with futures for the Dow, S&P 500, and Nasdaq all rising.

While the decision halts many of Trump’s tariffs, it does not affect his 25% tariffs on autos, auto parts, steel, or aluminum, which were imposed under a different law. The Department of Justice is expected to appeal the decision.
