Supreme Court Upholds Universal Service Fund, Preserving Affordable Internet and Phone Access
The U.S. Supreme Court on Friday affirmed the legality of the Universal Service Fund (USF), a critical program that helps provide affordable internet and phone services to low-income and rural communities, schools, and libraries across the nation. In a 6-3 decision, the justices rejected a challenge that sought to dismantle the fund on constitutional grounds.
The case centered on claims from a conservative advocacy group, Consumers' Research, which argued that Congress had violated separation-of-powers principles, specifically the "nondelegation doctrine," by granting too much authority to the Federal Communications Commission (FCC) and its administrator, the Universal Service Administrative Company (USAC), in determining and collecting the fees that support the fund.
Justice Elena Kagan authored the majority opinion, which concluded that Congress provided sufficient guidance to the FCC in establishing and administering the USF, and that the FCC's delegation to USAC did not constitute an unconstitutional transfer of power. Kagan's opinion emphasized that the longstanding work of Congress and the Commission in creating universal service programs has led to a more connected country while upholding the constitutional separation of powers.
Justices Samuel Alito, Neil Gorsuch, and Clarence Thomas dissented from the majority's decision. Justice Gorsuch, writing for the dissenters, argued that the ruling effectively allowed for an unconstitutional delegation of legislative power, particularly concerning the collection of fees that he viewed as a form of taxation.
The Universal Service Fund, established after the Telecommunications Act of 1996, collects billions of dollars annually through surcharges on U.S. consumers' phone bills. These funds are then used to subsidize various programs, including E-Rate, which provides discounts for internet access to schools and libraries; Lifeline, which assists low-income households; and programs supporting telecommunications services in rural and high-cost areas, as well as for rural health care providers.
The program has enjoyed bipartisan support, with both the Biden and Trump administrations backing the FCC's efforts to ensure widespread access to high-speed internet. The Supreme Court's decision is a significant relief for millions of Americans who rely on these subsidies and for the institutions that benefit from the fund's support. It ensures that the current system for financing and administering these vital telecommunications programs can continue unimpeded by this particular constitutional challenge.

UPDATE: The San Bernardino Sheriff’s Department have confirmed that one person has died and another two were injured after a home explosion on Ocotillo Rd in Twentynine Palms. Security camera video from a nearby neighbor captured the dramatic blast around 8:28 p.m., followed by a fire that brought a massive emergency response from fire and law enforcement agencies across the Morongo Basin. The burning structure has been confirmed as a residence at 6427 Ocotillo Ave. The cause of the explosion remains under investigation and the San Bernardino Sheriff’s Arson/Bomb Detail team is conducting the investigation.
