Justice Elena Kagan Warns Against Government Defiance of Court Orders
Supreme Court Justice Elena Kagan issued a stern warning Thursday about a rising challenge to the U.S. judicial system: the growing trend of government officials disregarding court orders.
Speaking at the 9th Circuit Judicial Conference in Monterey, California, Kagan stressed that compliance with court directives is essential to the rule of law. “This idea that litigants, and most especially here I’m talking about government officials, needn’t obey the dictates of courts… just is not the way our system works,” she said. “Judicial orders are judicial orders and need to be respected.”
Kagan’s comments come amid mounting concerns that members of the Trump administration have ignored legal rulings, particularly in contentious immigration cases. A recent whistleblower complaint from a former Justice Department attorney claimed a top DOJ official told colleagues to ignore court orders ahead of a March enforcement action—an accusation the official, Emil Bove, denies.
The issue has gained national attention, especially as Bove awaits Senate confirmation for a lifetime federal judgeship. Despite repeated accusations of noncompliance, few contempt proceedings have been initiated against officials.
Kagan also addressed broader issues facing the judiciary, including threats to judges’ personal safety and increased vilification of the bench. She referenced Chief Justice John Roberts’ earlier rebuke of President Trump for calling for the impeachment of judges who ruled against him.
“Judges are fair game for strong and pointed criticism,” Kagan said. “But vilifying judges in that way is a step beyond.”
