Justice Kavanaugh Defends Supreme Court’s Emergency Orders Amid Criticism

Supreme Court Justice Brett Kavanaugh on Thursday defended the court’s approach to emergency cases, often referred to as the “shadow docket,” during remarks at a judicial conference in Kansas City, Missouri.

The court has faced increasing criticism for issuing short, unexplained orders in cases, many involving policies pursued by President Donald Trump. These cases are decided quickly, without oral arguments and often with only a few pages of briefing, raising concerns about transparency and consistency.

“We have written a lot more than we’ve written in the past on the interim orders docket,” Kavanaugh said, explaining that the justices have increased the number of written opinions. However, he cautioned that writing too much can create a “lock-in effect,” prematurely revealing how the court might ultimately rule.

His comments come after Justice Elena Kagan suggested the court needs to “explain things better,” arguing that the public and lower courts deserve more clarity on these decisions.

The emergency docket has been used frequently during the Trump administration, covering cases on immigration, military policies, and the president’s power to remove leaders of independent federal agencies. One recent example allowed Trump to proceed with mass layoffs at the Department of Education with just a one-paragraph order.

Kavanaugh noted that the rise in emergency cases reflects modern presidents’ push to implement policies quickly, leading to fast-moving legal challenges.

The justice also highlighted steps the court has taken to provide more explanation, including holding oral arguments on some emergency matters. He underscored the importance of an independent judiciary, calling it the “crown jewel of our constitutional democracy.”
