Justice Department Seeks Supreme Court Review of Trump’s Birthright Citizenship Order
The Justice Department announced plans to ask the U.S. Supreme Court to swiftly rule on the constitutionality of President Donald Trump’s executive order aimed at ending birthright citizenship.
The announcement came in a court-ordered update on ongoing legal challenges to the controversial order. Last month, a federal appeals court upheld a lower court’s ruling that blocked the policy from taking effect nationwide.
In a separate case, another federal appeals court ruled the executive order unlawful, reaffirming that the 14th Amendment grants citizenship to all babies born on U.S. soil, regardless of their parents’ nationality or immigration status.
The administration’s move to seek a Supreme Court review could set up a high-stakes legal battle over one of the Constitution’s most debated provisions. If the high court agrees to hear the case in its next term, a decision could be issued by mid-2026.
