California Republicans Ask State Supreme Court to Halt Newsom’s Redistricting Push

California Republicans have filed an emergency petition with the state Supreme Court to stop Governor Gavin Newsom’s redistricting plan from moving forward. The Dhillon Law Group, joined by GOP lawmakers, argues that Democratic leaders are violating the California Constitution by bypassing the required 30-day public review period before acting on new legislation.

The dispute centers on a package of bills introduced August 18 that Democrats moved to committee consideration the same day. The legislation, part of what is being called the Election Rigging Response Act or Proposition 50, would place new congressional maps on the ballot for a November 4 special election. Lawmakers must act by August 22 to meet election deadlines, but Republicans say the rush tramples constitutional safeguards.

The effort is widely seen as California’s response to Republican-led redistricting in Texas, which is expected to add five GOP-leaning seats to the U.S. House of Representatives. Newsom’s proposal would add five Democratic-leaning seats in California, effectively neutralizing the Texas move. Critics, however, argue the plan undermines California’s independent redistricting system, established by voter-approved propositions in 2008 and 2010 to keep partisan politics out of the process.

Republicans have asked the court to halt all legislative activity related to the bills until September 18, or issue a decision sooner. They contend the legislature’s maneuvering violates the people’s rights under the state constitution and amounts to a power grab.

The legal challenge has fueled a heated political battle. Former Governor Arnold Schwarzenegger, who championed the independent redistricting commission, has also criticized the plan, calling it a betrayal of reform efforts. Legal experts say Democrats may face an uphill fight in defending their “gut-and-amend” approach, which allows lawmakers to replace bill language late in the session, but often sparks constitutional challenges.

The California Supreme Court is expected to weigh the petition quickly given the looming deadlines. The outcome could determine whether voters see a new congressional map on the November ballot and whether California’s redistricting process remains in the hands of an independent commission or shifts back into the political arena.
