New Trials Ordered for 3 Former Memphis Officers in Tyree Nichols Case
Three former Memphis police officers convicted in the 2023 death of Tyree Nichols will receive new trials.
On Thursday, U.S. District Judge Sheryl H. Lipman ruled that officers D’Darius Bean, Demetrius Haley, and Justin Smith are entitled to retrials due to concerns about the appearance of judicial bias in the original proceedings.
The three men were previously convicted on federal charges for their role in the fatal beating of Nichols, which was captured on video and sparked national outrage. However, they were acquitted in May on separate state charges.
In her ruling, Judge Lippman emphasized that “the risk of bias here is too high to tolerate,” underscoring the importance of fairness in cases with significant public impact. She concluded that new trials are necessary to ensure justice is served.
Nichols’ death in January 2023, after being violently beaten during a traffic stop, drew widespread protests and renewed calls for police reform across the country.
The new trial dates have not yet been set.
