Menendez Brothers Resentenced to 50 Years to Life, Eligible for Parole After 35 Years Behind Bars
A Los Angeles judge has resentenced Erik and Lyle Menendez to 50 years to life in prison, opening the door for possible parole after 35 years behind bars for the 1989 murders of their parents, Jose and Kitty Menendez.
The decision came from Judge Michael Jesic, who acknowledged the brutality of the crime but said he was moved by the letters from prison staff describing the brothers’ rehabilitation. “A horrific crime was committed,” Jesic said, “but it’s remarkable what the brothers have done.”
The ruling means the brothers are now eligible for parole, though Jesic clarified he is not suggesting their release—only that “one day they should get that chance.” A parole hearing has already been scheduled for June 13, and the final decision will rest with the California parole board and Governor Gavin Newsom.
In court, both brothers accepted full responsibility for their actions. Erik Menendez told the judge, “I committed an atrocious act against two people who had every right to live—my mom and dad,” while Lyle Menendez reflected on his immaturity and the years of trauma leading up to the murders.
Their defense attorney, Mark Geragos, called the ruling a milestone, saying it shows “that redemption is possible.”
Family members testified in support of the brothers’ release, describing years of remorse and service inside prison. Relatives cited the brothers’ founding of inmate programs and efforts to help others as evidence of their transformation.
Prosecutors, however, pushed back, arguing that the brothers have not fully acknowledged their lies or manipulation of the case. They also cited recent prison violations involving cell phones and a parole board assessment finding the brothers pose a “moderate” risk if released.
Governor Newsom has 120 days to review any parole recommendation if the board votes in favor of release. He also retains the authority to commute their sentences, though he has not yet done so.
Attorneys for the brothers continue to pursue a new trial, citing new evidence of alleged abuse by their father.
