Federal Judge Orders Release Of Kilmar Abrego Garcia After Controversial Deportation And Return To U.S.

Kilmar Abrego Garcia was released from an immigration detention facility in Pennsylvania on Thursday after a federal judge ordered his immediate release, ending nearly nine months of repeated detainments connected to a highly scrutinized immigration case. The Maryland father first entered the United States illegally around 2011 and became the focus of national attention after the Trump administration deported him earlier this year despite a 2019 judicial order prohibiting his removal to El Salvador due to documented fears of persecution.
Officials later admitted that Abrego Garcia was deported “because of an administrative error,” and he was returned to the United States in June. He now faces charges for allegedly helping smuggle undocumented immigrants into the country, a charge to which he has pleaded not guilty. His trial is scheduled to begin in January.
Former Miami-Dade County Court Judge Jeff Swartz noted that although Abrego Garcia has been released, he remains under home confinement and subject to strict conditions. The administration has signaled its intent to continue pursuing his removal and has been looking at deporting him to countries in Africa with which he has no ties, a move the federal judge sharply criticized.
The White House condemned the judge’s decision to release Abrego Garcia, calling him a proven gang member and human trafficker, claims his defense disputes. Press Secretary Karoline Leavitt stated that the administration plans to continue fighting the case in court.
Under the terms of his pretrial release, Abrego Garcia must remain at his brother’s residence in Maryland and cannot leave the state without court permission. He is only allowed to leave home for work, religious services, medical needs, or court appearances.
