Chief Justice John Roberts Emphasizes Judicial Independence in Year-End Supreme Court Report

Chief Justice John Roberts is reaffirming the independence of the federal judiciary in a year-end report that looks to American history for guidance amid today’s political climate.

In the annual report released Wednesday, Roberts described the judiciary as a vital “counter-majoritarian check” within the nation’s system of government. As the country approaches the 250th anniversary of the Declaration of Independence, Roberts highlighted how the nation’s founders deliberately created courts that would operate free from interference by the executive and legislative branches.

“This arrangement, now in place for 236 years, has served the country well,” Roberts wrote, emphasizing the long-standing role of the courts in upholding constitutional principles.

The report avoids direct references to modern political controversies and does not mention President Donald Trump by name. Still, it arrives amid ongoing tension between federal courts and the White House, including criticism from Trump over court rulings that have slowed or blocked parts of his agenda. Trump has publicly questioned the legitimacy of some judges and called for impeachment of those who ruled against his administration.

Many of those disputes have reached the Supreme Court through emergency appeals, often referred to as the “shadow docket.” In those cases, the high court has frequently sided with the administration, drawing criticism from some lower court judges and legal scholars who argue the decisions lack transparency.

Roberts’ report also revisits the 1804 impeachment of Supreme Court Justice Samuel Chase, the only justice ever impeached. Chase was ultimately acquitted, a decision Roberts says helped cement the principle that judges should not be removed simply for unpopular rulings. He quoted former Chief Justice William Rehnquist, noting that the outcome ensured judicial independence from partisan pressure.

Earlier this year, Roberts issued a rare public statement pushing back on calls to impeach judges, saying disagreement with a court decision is not grounds for removal.

In closing, Roberts cited President Calvin Coolidge, reminding readers that even amid partisan conflict, the nation can find stability in the Constitution and the Declaration of Independence.

“True then,” Roberts wrote. “True now.”
