Federal Judge Holds Government Attorney in Contempt Over Immigration Case Violations in Minnesota

A federal judge in Minnesota has held a government attorney in civil contempt, citing repeated violations of court orders in an immigration detention case — a move legal experts say marks a significant escalation in the courts’ response to compliance failures.

U.S. District Judge Laura Provinzino ruled that government lawyer Matthew Isihara showed “flagrant disobedience of court orders” in a case involving a noncitizen detained during an immigration crackdown earlier this year. The judge ordered that beginning Friday, Isihara must pay $500 per day until the individual receives identification documents that should have been returned upon release from custody.

The judge had previously ordered the release of the man, a Mexican national who had lived in Minnesota since 2018, determining his detention was unlawful. She also required that all of his property be returned and that he be released in Minnesota. According to the court, those instructions were not followed — the man was released in Texas, and key documents were not returned.

Isihara told the court the failure was not intentional and stemmed from heavy caseloads tied to “Operation Metro Surge,” a large immigration enforcement effort that has produced a surge of legal challenges. The judge rejected that explanation, stating that staffing issues and administrative burdens do not justify ignoring court orders.

Courts in Minnesota and other states have raised growing concerns about similar compliance problems, with officials acknowledging dozens of violations across immigration cases. Some involve transfers of detainees despite court restrictions, missed deadlines, or delays in required hearings.

Legal analysts say the monetary sanction signals a turning point, showing judges are increasingly willing to use enforcement powers to compel compliance.
