West Virginia Attorney General Sues Apple Over Alleged Child Abuse Material on iCloud
West Virginia’s attorney general has filed a lawsuit against Apple, alleging the company allowed child sexual abuse material (CSAM) to be stored and shared through its iCloud service for years.
The complaint claims Apple prioritized user privacy over child safety and failed to implement adequate detection and reporting systems, despite having full control over its devices, software, and cloud infrastructure. The lawsuit also argues Apple did not meet federal reporting expectations when compared with other technology companies. According to the complaint, Apple filed far fewer reports of detected abuse material than some competitors.
Attorney General JB McCuskey said companies with significant resources have a responsibility to help address the spread of exploitative content, calling the alleged failures unacceptable.
Apple disputes the claims and says protecting children is a core priority. The company highlighted existing safety features, including Communication Safety tools that warn and blur images containing nudity for child users across services such as Messages, FaceTime, and AirDrop. Apple also pointed to parental controls designed to improve child safety while maintaining user privacy.
The lawsuit also revisits Apple’s abandoned NeuralHash detection system, which the company scrapped in 2021 following criticism that it could compromise user privacy. West Virginia officials argue Apple should have implemented stronger detection technology, such as widely used image-matching tools.
The case is part of growing scrutiny of how major technology companies handle online safety, particularly involving children. West Virginia is seeking damages and court orders requiring Apple to adopt more effective detection and reporting measures.
