Federal Judge Criticizes Justice Department Over Search of Washington Post Reporter’s Home

A federal judge is criticizing the Justice Department after learning prosecutors did not fully address a key press protection law when seeking a warrant to search the home of a Washington Post reporter.

During a court hearing in Alexandria, Virginia, Magistrate Judge William Porter questioned why the department failed to highlight the potential applicability of the Privacy Protection Act of 1980 — a law designed to shield journalists from government searches and seizures of their work materials, except in limited circumstances.

The judge said he found it difficult to understand how the law would not apply in the case. He also expressed concern about the scope of the search and the amount of information seized.

Federal agents searched reporter Hannah Natanson’s home last month and took multiple devices, including phones and computers. The search stemmed from her communications with a government contractor accused of illegally leaking classified information. Natanson herself is not under criminal investigation.

After the search, Natanson and the Washington Post filed a legal challenge seeking the return of the seized materials. Porter has temporarily blocked investigators from reviewing the devices while the dispute continues.

Justice Department attorneys told the court they did not believe the press protection law applied. The judge pushed back strongly, questioning whether prosecutors had a duty to raise the issue when requesting the warrant.

Press freedom advocates say the case raises serious concerns about protections for journalists and confidential reporting. The court is now weighing whether to order the return of the materials or establish a process to separate relevant evidence from unrelated reporting work.

A decision is expected in the coming weeks.
