James Comey Surrenders and Appears in Court Over 'Seashell' Threat Charges

Former FBI Director James Comey surrendered to law enforcement Wednesday morning before making his initial appearance in a federal courtroom in Alexandria, Virginia. The surrender follows a Tuesday indictment charging Comey with making a threat against President Donald Trump and transmitting that threat in interstate commerce.

During the brief hearing, which lasted less than 10 minutes, Judge William Fitzpatrick ordered Comey’s release with no conditions. The judge noted that no conditions were deemed necessary during the government's previous, unsuccessful attempt to prosecute Comey last year. The former director, dressed in a dark suit, did not speak during the proceedings and was not asked to enter a plea.

Attorneys for Comey signaled a aggressive defense strategy, informing the court of their intent to file motions accusing the Department of Justice of "selective and vindictive prosecution." This latest case is being overseen by U.S. Attorney Ellis Boyle of the Eastern District of North Carolina, though the initial appearance was held in Virginia for the defendant's convenience.

Legal scholars, including First Amendment specialist Eugene Volokh, have expressed skepticism regarding the charges, labeling the post as "not a punishable threat." This marks the second major legal action against Comey under the current administration, following a previous case involving alleged leaks that was dismissed late last year due to procedural errors in the appointment of the prosecutor.
