PORT CHARLOTTE, FL — New details have been released regarding the arrest of Heather Mashburn-Smith, a 37-year-old teacher at Port Charlotte High School, who is accused of engaging in sexual activity with a student in her classroom.

The investigation began after the school's principal, James Vernon, contacted the Charlotte County Sheriff’s Office. Vernon reported receiving an allegation of an inappropriate relationship between a staff member and a student through the ParentSquare app.

According to the arrest affidavit, the victim told deputies that he and Mashburn-Smith had been involved in an inappropriate relationship for approximately four to five weeks. The interaction reportedly began in a group chat on Snapchat and escalated after Mashburn-Smith sent him a private message.

The victim stated that he frequently visited Mashburn-Smith’s classroom to talk, where the conversations became flirtatious. According to the affidavit, the two eventually kissed in the classroom, at which point Mashburn-Smith allegedly warned the student not to tell anyone because she could "get in trouble."

The victim detailed two separate occasions where he and Mashburn-Smith engaged in sexual activity inside the classroom. He also told investigators that the teacher expressed a desire to leave her husband for him once he turned 18. The victim eventually blocked her on social media, though the affidavit notes she continued to attempt to contact him.

When questioned by deputies, Mashburn-Smith reportedly admitted she had "made a mistake" and had gotten too close to the student. While she characterized the situation as an "emotional relationship," she allegedly confessed that the teenager made her feel "special and desired." She also expressed remorse, noting that she was a married woman.

Heather Mashburn-Smith was arrested Wednesday and is currently facing charges of unlawful sexual activity with certain minors.
