Supreme Court Poised to Revisit Major Precedents on Campaign Finance, Prayer, Military Suits, and Same-Sex Marriage

Supreme Court Poised to Revisit Major Precedents on Campaign Finance, Prayer, Military Suits, and Same-Sex Marriage

The Supreme Court is preparing to take on several cases this fall that could alter, or even overturn, long-standing precedents touching on issues ranging from presidential power to religious freedom. Legal scholars and political observers are closely watching as the court’s 6-3 conservative majority shows continued willingness to revisit rulings once thought settled.

One major target is Humphrey’s Executor v. United States, a 1935 decision shielding the heads of independent federal agencies from being fired by the president without cause. With Donald Trump eager to consolidate power in his second term, the ruling’s survival appears uncertain. Recent emergency orders have already allowed him to dismiss Biden appointees, raising alarms from the court’s liberal justices.

Campaign finance law also faces potential upheaval. The justices agreed to hear a challenge to a 2001 decision limiting how much political parties can coordinate spending with candidates. Republicans argue the restrictions are outdated and violate the First Amendment, while Democrats warn that removing the cap could unleash an even greater flood of donor money into campaigns.

The 2015 ruling in Obergefell v. Hodges, which legalized same-sex marriage nationwide, is also back in the spotlight. Former Kentucky clerk Kim Davis, who refused to issue marriage licenses to same-sex couples, is appealing fines tied to her defiance. While many experts doubt her case will overturn Obergefell, her arguments highlight how religious freedom claims continue to test the boundaries of marriage equality.

Redistricting will also take center stage as the court revisits Louisiana’s congressional map. At issue is whether drawing majority-minority districts to comply with the Voting Rights Act is constitutional. A ruling against such districts could dismantle key protections dating back to the 1986 Thornburg v. Gingles decision.

The justices may also reconsider the Feres Doctrine, a 1950 ruling barring service members from suing the government for injuries tied to their service. The case stems from a Missouri traffic accident that killed an Air Force staff sergeant. Critics argue the doctrine unfairly blocks military families from seeking justice in routine cases that civilians could pursue.

Finally, religious groups are pressing the court to overturn a 2000 ruling that barred student-led prayer over loudspeakers at high school football games. The Florida case involves a Christian school that was prevented from broadcasting a pregame prayer. With recent rulings favoring religious expression, court conservatives may be open to revisiting Santa Fe Independent School District v. Doe.

Taken together, the cases could profoundly reshape American law across government accountability, civil rights, and the First Amendment.
