Supreme Court Tariff Case Could Force $80 Billion in Refunds to US Businesses
A Supreme Court decision this fall could determine the fate of President Donald Trump’s sweeping tariffs — and potentially trigger one of the largest corporate refunds in U.S. history.
The case stems from Trump’s reliance on the International Emergency Economic Powers Act (IEEPA) to impose broad duties during his second term. The tariffs pushed import tax rates as high as 50% on India and Brazil, and up to 145% on China earlier this year. On August 29, a federal appeals court ruled the use of IEEPA was unlawful, setting the stage for a high court showdown on November 5.
If the Supreme Court rules against Trump, American businesses could recover nearly $80 billion already paid in tariffs deemed illegal. However, trade experts caution that refunds would not come quickly or easily. Options include full refunds to all affected companies, limiting refunds to named plaintiffs, or requiring importers to apply through an administrative process.
For now, businesses continue to pay tariffs while awaiting the verdict. Some importers are filing protests with U.S. Customs to preserve their claims, while investment firms are attempting to buy stakes in potential refunds.
Economists warn that mass refunds could disrupt the broader economy. Treasury would need to replace the lost revenue by borrowing more, likely raising bond yields and borrowing costs. Analysts also caution that pumping refunds back into the economy could fuel inflation.
Trump has acknowledged that if he loses, the Treasury may have to “give back” the money. At stake is not only his trade policy but also billions of dollars that could reshape corporate balance sheets and federal finances alike.
